online pharmacy, DocMorris won a court battle in its
pursuit to conduct sales of prescription medications
such as Viagra,
Cialis, Tamiflu etc. by mail-order in Germany.
The federal cour located in the city of Karlsruhe overturned a lower court's
decision that prevented such sales of prescription
Medications online.
Next, the higher court in Berlin must hear the case to
determine if DocMorris which claims to be Europe's biggest
online pharmacy, abides by German safety standards for pharmaceuticals.
The judges acknowledged that the German health ministry had determined in
a report released in 2005 that the Dutch system of
pharmaceuticals was comparable to the German one.
Although medications can be can be ordered online, they must
contain the original prescriptions sent to DocMorris by post.
DocMorris online pharmacy is not tied to Germany's fixed minimum price system for
prescription medications and therefor might pose a threat to its
German based competitors. A large percent of its customers are German.
Nearly 90% of orders for medications placed with DocMorris are for
medications that require a prescription. DocMorris expects to post $286 million in
revenues during its 2007 operations.
The court warned of the possible abuse or incorrect use of prescription drugs, given the limited level of control over
online sales of prescription
medications.
